Terms of Service

1. Service Description

Brand Generator is an AI-powered brand identity generation platform. It offers:

  • Brand Kit Generation: Complete brand identity kits including name, slogan, logo (SVG + PNG), color palette, typography, favicon, OG image, email signature, and Tailwind theme — generated from a simple product description.
  • Reshuffles: Each kit includes a limited number of reshuffles to regenerate individual sections until you are satisfied.
  • Export: Download all assets as a production-ready ZIP file. Exporting permanently locks the kit — reshuffles and edits are disabled after export.

2. AI-Generated Content

Brand kits are generated using artificial intelligence. Brand Generatordoes not guarantee that generated names, slogans, or visual assets are unique, free of trademark conflicts, or suitable for any specific purpose. It is the user's responsibility to verify trademark availability and legal compliance before using generated content commercially.

The platform is provided "as is" without expressed or implied warranties regarding the adequacy of generated content for a specific purpose.

3. Registration and Account

3.1 Requirements

  • Must be 18+ years old with a valid email address
  • One account per person
  • Information must be truthful and current

3.2 User Responsibility

  • Users are responsible for maintaining credential confidentiality
  • All account activity is the user's responsibility
  • Report unauthorized access immediately

4. Credits and Payments

4.1 Credit System

One credit equals one complete brand kit generation. Credits are purchased in packs via one-time payments (no subscriptions). Credits never expire.

4.2 Payments

Payments are processed securely by Stripe. Brand Generator does not store credit card data on its servers. Users can view invoices and payment history through the Stripe Customer Portal accessible from their account menu.

4.3 Refunds

  • Automatic refund: If a brand kit generation fails due to a system error, the consumed credit is automatically refunded to your account.
  • Reshuffle refund: If a reshuffle fails, the reshuffle count is automatically restored.
  • Credits are non-refundable once purchased, except in cases of generation failure as described above.

4.4 Right of Withdrawal

Per applicable consumer protection laws, users may request cancellation and full refund within 7 calendar days after purchase, provided no credits have been consumed. Contact support to exercise this right.

5. Export and Kit Locking

When you export a brand kit, it is permanently locked. This means all remaining reshuffles are disabled and no further edits can be made. This is by design — the exported kit represents your finalized brand identity. Make sure you are satisfied with all sections before exporting.

You may re-download an already exported kit at any time without additional cost.

6. User Obligations

Users commit to:

  • Providing truthful personal data and keeping registration current
  • Not using the platform for illegal or unauthorized purposes
  • Not scraping, automating data collection, or reverse engineering the platform
  • Not accessing restricted areas or bypassing security measures
  • Not sharing accounts with third parties
  • Not reproducing, distributing, or commercializing platform content (other than your own generated brand kits) without authorization

7. Intellectual Property

The Brand Generator platform — including its brand, logo, layout, source code, and functionality — is protected by intellectual property law.

Your brand kits are yours. Once generated, you own full commercial rights to use the generated name, slogan, logo, colors, and all other assets in your brand kit. Brand Generator does not claim ownership over your generated content.

8. Liability Disclaimer

Brand Generator is not responsible for:

  • Business decisions made based on generated brand content
  • Trademark conflicts arising from use of generated names or logos
  • Temporary service unavailability from maintenance or uncontrollable factors
  • Direct or indirect damages from platform use

9. Service Availability

The platform operates 24/7, though programmed or emergency maintenance may cause temporary unavailability. Users receive advance notification when possible.

10. Suspension and Termination

The platform may suspend or terminate accounts for Terms violations, abusive use, false registration information, or fraudulent activity. Notification precedes suspension except in severe violations requiring immediate action.

11. Privacy

Personal data treatment is governed by our Privacy Policy, which is an integral part of these Terms.

12. Terms Modifications

The platform may update these Terms periodically. Significant changes are communicated via email or platform notice. Continued service use after modifications constitutes acceptance of updated terms.

13. Applicable Law

These Terms are governed by applicable law in the user's jurisdiction. For users in Brazil, the Consumer Protection Code (Law 8.078/1990), the Internet Civil Rights Law (Law 12.965/2014), and the General Data Protection Law — LGPD (Law 13.709/2018) apply.
